VisionicX – Terms of Service (ToS)

1. Introduction
Welcome to VisionicX (“VisionicX,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of all VisionicX products and services, including:
- Energy Monitoring System (EMS): IoT devices, smart plugs, controllers, energy monitoring dashboards, mobile and web apps.
- Management System: Institutional/organizational software modules (academic, attendance, finance, exams, HR, hostel, transport, inventory, etc.).
- AI Projects: CCTV/video analytics, face recognition, predictive AI, automation, and activity insights.
By using our Services, you (“User,” “Customer,” “Organization”) agree to these Terms. If you do not agree, you may not use our Services.
2. Eligibility
- You must be at least 18 years old or legally capable of entering into a binding contract.
- Organizational accounts must be managed by authorized representatives.
- Services are not intended for unsupervised use by children under 16.
3. Scope of Services
VisionicX provides:
- EMS Devices & Services: IoT devices, real-time monitoring, control, analytics dashboards.
- Management System: Academic year setup, branch/section management, attendance, timetable, exams, fees, stationary, inventory, HR, transport, hostel, tasks, documents, leave, permissions, finance dashboards, and reporting modules.
- AI Projects: Integration with CCTV/camera feeds, AI-powered detection, attendance automation, predictive analytics, and reporting.
- Setup & installation support (on-site or remote).
- Customer support, troubleshooting, and issue resolution.
We may modify, suspend, or discontinue Services with reasonable prior notice.
4. User Responsibilities
You agree to:
- Provide accurate account and registration information.
- Maintain confidentiality of login credentials.
- Use Services lawfully and responsibly.
- Maintain proper network, environment, and compliance for devices.
- Comply with applicable academic, organizational, and data protection laws.
You may not:
- Attempt unauthorized access, reverse engineer, or tamper with VisionicX software/hardware.
- Use Services for unlawful, fraudulent, or malicious purposes.
- Share or transfer accounts without authorization.
5. Device Use & Installation (EMS)
- Devices must be installed by qualified personnel or VisionicX-approved methods.
- VisionicX is not responsible for damages caused by improper installation, misuse, or unauthorized modifications.
- Firmware/security updates may be automatically applied to ensure functionality and safety.
6. Data & Privacy
- By using Services, you consent to data collection and processing in accordance with our Privacy Policy.
- EMS data (voltage, consumption, performance), Management data (academic, financial, operational), and AI analytics (camera/video data) remain the property of the customer/organization.
- VisionicX uses strict security measures but cannot guarantee absolute protection against cyber risks.
7. Support & Issue Handling
- Support available via email, phone, or in-app channels.
- Diagnostic data may be requested (with consent) for troubleshooting.
- Critical issues are prioritized but resolution times are not guaranteed.
8. Fees & Payments
- Some Services require subscriptions or one-time payments.
- Pricing, billing cycles, and methods are communicated transparently.
- Failure to pay may result in suspension or termination.
- Refunds follow applicable laws and our Refund & Warranty Policy.
9. Intellectual Property
- VisionicX owns all devices, software, AI models, code, and trademarks.
- Users are granted a limited, non-exclusive, non-transferable license.
- Unauthorized copying, modification, or commercial exploitation is prohibited.
10. Limitations of Liability
- VisionicX is not liable for indirect or consequential damages (e.g., downtime, business interruption, data loss).
- Total liability will not exceed the total amount paid by the customer in the past 12 months.
11. Warranties & Disclaimers
- EMS devices are covered by manufacturing warranty policies.
- Management System & AI Services are provided on an “as is” and “as available” basis.
- We do not guarantee uninterrupted, error-free, or fully secure operation.
12. Termination
We may suspend or terminate Services if:
- Users violate these Terms.
- Services are misused unlawfully.
- Payments are not made as required.
Users may terminate anytime by contacting support. Obligations like unpaid fees may survive termination.
13. AI & CCTV Usage Disclaimer
- AI models act as decision-support tools, not absolute judgments.
- Video/camera feeds are processed securely and not stored beyond necessity.
- VisionicX is not responsible for regulatory/legal issues from misuse of AI analytics.
- Customers are responsible for compliance with local CCTV, biometric, and privacy laws.
14. Governing Law & Dispute Resolution
- These Terms are governed by the laws of India (or applicable jurisdiction if specified in agreement).
- Disputes should first attempt amicable resolution.
- If unresolved, disputes fall under the jurisdiction of courts in Andhra Pradesh, India (or mutually agreed jurisdiction).
15. Changes to Terms
We may update these Terms periodically. Continued use after updates indicates acceptance of the revised Terms.
